Content: All services provided by Wiredhub may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Canadian and U.S. Federal, Provincial, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening to our network or obscene, or material protected by trade secrets and other statutes. File download web sites, download mirrors and websites of similar nature are strictly prohibited and are subject to immediate suspension or termination. Wiredhub is not responsible for any claims resulting from the use of our service. This also holds true for sites that promote any illegal activity or content that may be damaging to Wiredhub servers or any other server on the internet. Links to such materials are prohibited. Wiredhub servers restricts such files as Adult sites, pirated software, hacker programs/archives, MP3, and Warez sites or anything else that is illegal according to federal law.

Reselling: Reselling is allowed on our Resellers plans.  Subletting/Reselling of space is strictly prohibited on shared hosting accounts.  Shared hosting accounts that sublet/resell their web space/domains/sub-domains will be subject to immediate suspension or termination.

Commercial Advertising: Email (SPAM): Spamming, or the sending of unsolicited email, from a Wiredhub server or using an email address that is maintained by Wiredhub is STRICTLY prohibited and will qualify your site for immediate deactivation with no refund.

Server abuse: Any attempts to undermine or cause harm to any Wiredhub server or customer of Wiredhub is strictly prohibited. Wiredhub holds no responsibility for the use of our clients' accounts. Any account(s) that abuses the server will be instantly de-activated with no refund and will be charged the cost of the damage upon the servers. If Wiredhub’s system administration team determines that a customer's account is utilizing an unacceptable amount of system resources, Wiredhub may temporarily  or permanently deactivate the account in question depending on the severity. If Wiredhub's staff deems necessary, an eviction notice may be sent to the customer of an offending account.

We do not allow IRC or IRC bots to be operated on our servers. Any account found to be in violation of this provision will be immediately suspended and/or deactivated and no refund will be issued.

Any attempt to circumvent domain parking restrictions by using selective HTTP redirects or any other method to send traffic from parked domains to sites other than the main site is strictly prohibited.  If multiple domain names with separate content are required, addon domains must be used instead.

Customers are not permitted to run programs in the background. This tends to use a lot of system resources, and can impair service to other customers on that server.

Back-ups: Wiredhub performs backups on all of our servers to ensure critical files are not lost. Our server creates backups for user’s sites that you may download on your own, we are not obligated to restore a file any user has accidentally deleted or modified.  The backups performed on all our servers are in no way guaranteed. The back-up restoration is for emergency procedures only. You are advised to backup all of your own files to your local drive. Wiredhub is NOT responsible for lost data, time, income or any other resource due to faulty backups or non existent back-ups. We recommend that you backup your site at your own intervals from the backup download option provided in the Control Panel.

90 Day Money Back Guarantee: Each new registration of a hosting account is entitled to a 90 day (no hassle) money back guarantee. Any hosting account that wishes to cancel (for any reason) will be entitled to a full refund of funds collected for the first three months. If the account is terminated within the first 90 days of service due to a breach of our Terms of Service, no refund will be issued. Please note that if you registered the domain through us, the domain registration fee is non-refundable.

Rapid Response Guarantee: The “Rapid Response Guarantee” guarantees that you will receive a reply from our tech support dept. in under 3 hours. A client is entitled to obtain a service credit of 10% of the respective hosting account’s monthly fee only if the initial reply to the client was greater than 3 hours. The guarantee only holds true for issues related to tech support and which are submitted to the Technical Support department. A credit can be applied only once per ticket and has to be claimed within 72 hours of the ticket’s submission. Service Credits can only be used towards account fees.

99.9% Uptime Guarantee: If the Uptime Guarantee of 99.9% is not met the user must submit within 7 days of the outage proof indicating the accurate length of the outage. At which time the request is verified a credit will be issued at the following rate:

99.91% - 100% Uptime: No Credit
99.5% - 99.9% Uptime: 25% of your monthly bill
99.0% - 99.5% Uptime: 50% of your monthly bill
Less than 99.0% Uptime: 100% of your monthly bill

Service Credits can only be used towards account fees.

Billing: Payments will be billed on the same date as the customer signed up on. A customer has the right to ask for a refund only if the account has been active less than 90 days. If the account exceeds that period time a refund will not be given. If a user has such a plan where he paid money upfront (for example a yearly plan) and the customer exceeds more than 90 days, no refund can be returned.

Cancellation: Cancellation can be made via a ticket to our Billing dept. through the customer cared desk located at http://www.wiredhub.net/customer-care.html. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. If cancellation is made within the first 90 days of service all hosting fees will be refunded. This does not include fees for domain registration. We reserve the right to remove any account without advanced notice for any reason Wiredhub sees fit.

Indemnification: Client agrees to indemnify, defend and hold Wiredhub and its affiliates, agents, employees, and licensors (including the third party service providers) harmless from any and all claim, demand, loss, costs or expense, including attorneys' fees, made by any person arising out of Client's violation of this Agreement, State or Federal Securities laws or regulations, or any other person's rights including but not limited to infringement of any copyright or violation of any proprietary or privacy right.

Under no circumstances, including but not limited to a negligent act, will Wiredhub or its affiliates, agents, employees, or licensors (including third party service providers) be liable for any damages of any kind that result from the use of, or the inability to use, Services, even if any such party has been advised of the possibility of such damages.

In no event will Wiredhub or its third party service providers be liable to Client or any third Party for any tort, contract or any other liability arising in connection with the use of the Services, or reliance on any information or services provided by Wiredhub. Wiredhub and its third party service providers will under no circumstances be liable to Client and/or any third party, regardless of the form of action, for any loss of profits, goodwill, use, data or other intangible losses, or any direct, indirect, special, consequential, incidental or punitive damages whatsoever, even if Wiredhub or its third party service providers has been advised of the possibility of such damages, resulting from: (i) the use of the inability to use the Services; (ii) the timeliness, deletion, misdelivery, or failure to store any user data, communications or personalization settings; (iii) the cost of getting substitute goods and services resulting from any products, data, information or services purchases or obtained or messages received or transactions entered into, through or from the Services; (iv) statements or conduct of anyone on the Services; (vi) the use, inability to use, unauthorized use, performance or non-performance of any third party, even if the third party has been advised previously of the possibility of such damages; or (vii) any other matter relating to the Services. Client agrees that Client will not in any way hold Wiredhub responsible for any selection or retention of, or the acts or omissions of, third parties (including third party service providers) in connection with the Client Services.

Because some states prohibit the limitation of liability for consequential or incidental damages, in such states the limitation of liability only with respect to consequential or incidental damages may not apply to Client, and the respective liability of Wiredhub and its third party service providers, employees, distributors and agents is limited to the greatest extent allowable under applicable law in those states.

In the event that a court or arbitration panel, as the case may be, should hold that the limitations of liability or remedies available as set forth in this Agreement, or any portions thereof, are unenforceable for any reason, or that any of Client's remedies under this Agreement fail, then Client expressly agrees that under no circumstances will the total, aggregate liability of Wiredhub and its third party service providers, employees, distributors, agents or affiliates, to Client or any party claiming by or through Client for any cause whatsoever exceed $100 (U.S.), regardless of the form of action and whether in contract, statute, tort or otherwise.

This paragraph shall remain in effect for three years after the termination of this Contract.

Refusal of Service: We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Wiredhub will not be responsible for any damages your business may suffer, Wiredhub makes no warranties of any kind, expressed or implied for services we provide.

These terms may be modified at any time and without notice. All users previous and new are always subject to the newest terms posted here at all times.

Failure to fully comply with these terms is grounds for account suspension and/or deactivation (with or without refund, subject to Wiredhub's discretion). Any accounts and/or servers contained within Wiredhub's network must adhere to the above policies.

We reserve the right to remove any account without prior notice. If we deactivate your account for violating policy, you will forfeit your rights to a refund--and none will be given. No refunds for advanced payment. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.
